Kathleen Hewko is taking legal action after using the handicapped toilet in a sports bar, where the seat she was sitting on cracked, leaving her wedged in the bowl.
The victim claims she had hip surgery prior to the accident and was injured again when the seat broke.
The lawsuit is aimed at Starters and Kohler Co, of New Jersey, US, the company that made the toilet seat, though the company declined to comment.
