TERMS AND CONDITION
- By entering this competition, you accept and agree to be bound by the following terms and conditions:
1. This competition is open to all permanent Australian residents aged 15 years or over and who are not (i) employees of, or contractors to, the Promoter and any affiliates or subsidiary, or any agents or representatives of the Promoter involved with this competition, or (ii) members of the immediate family of such employees and contractors. “Immediate family” means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by parent), whether or not they live in the same household as the employee/contractor.

2. Entries must be
(i) the original independent creation of the entrant,
(ii) owned by the entrant, and
(iii) free of any claims, including copyright or trademark claims, by other parties.
Entries must not have
(i) published previously,
(ii) won prizes or awards in other competitions,
(iii) be restricted in any way, or
(iv) infringe any third party rights.- 3. There will be 1 first prize winner and 24 runner up prize winners. The prize(s) will consist of:
- a. 1 major prize pack comprising: 1x limited edition Dark Knight statuette with authentication certificates, valued at $200.00 courtesy Warner Home Video; 1x in-season double pass to see The Dark Knight, valued at $32.00 courtesy of Warner Bros and Roadshow Films; 1x Batman Begins DVD - 2-Disc Special Edition valued at $19.95 courtesy of Warner Home Video. Total value: AUD$251.95 (“Major Prize Pack”)
- b. 24 runner up prizepacks comprising: 1x in-season double pass to see The Dark Knight, valued at $32.00 courtesy of Warner Bros and Roadshow Films; 1x Batman Begins DVD - 2-Disc Special Edition valued at $19.95 courtesy of Warner Home Video. Total value AUD$51.95 (each a “Runner Up Prize”). The total prize pool value of the competition is AUD$1498.75. Prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winners. The promoter may substitute items in the prize pool for alternative items of the same value
- 4. The competition commences at 12:01am on 16 July 2008 [to be confirmed] and closes at 11:59pm on 6 August 2008 (the “Closing Date”). Any entries received after the Closing Date will not be accepted by the Promoter.
- 5. At or around 11:00am on 7 August 2008 the judges will choose 1 winner with the most creative and original response to the Competition Question to win the Major Prize Pack. The judges will then select 24 winners with the next most creative responses to the Competition Question to win a Runner Up Prize each. The winner(s) will be notified by email within 5 working days. To contact you we will use the contact details supplied by you when entering the competition. Prizes will be sent to the postal address supplied in the entry form.
- 6. If you are notified of a winning entry, you must confirm acceptance over the phone or by email to claim your prize. If you do not reply to confirm acceptance within 5 days of being notified as a winner, we may offer your prize to someone else.
- 7. Chance plays no part in determining the winners. The Promoter reserves the right to disqualify any entrant submitting an entry, which, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. Illegible, incomplete, late or defaced entries will be disqualified. The judges’ decision is final and no correspondence will be entered into.
- 8. Only one entry per person is permitted.
- 9. All prize(s) are non-transferable, exchangeable or redeemable for cash and where prize(s) consist of tickets to events, all such tickets are non-refundable. The Promoter reserves the right to substitute prize(s) of an equivalent value should the prize(s) become unavailable for any reason. If any winner is not able for whatever reason to accept the prize(s), then the Promoter reserves the right to award the prize(s) to another participant.
- 10. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter, its associated companies and agencies, and the agencies and companies associated with this competition, will not be liable for any loss (including but not limited to indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any persons’ negligence) by any person in connection with this competition or accepting or using a prize and, where applicable, to any family/persons accompanying the winner. The winner and his or her guests must sign and return any liability release provided by the Promoter and/or its contractors as a condition of the prize being awarded. A winner and any guests under 18 years must be accompanied by a parent or guardian who signs any liability indemnity provided by the Promoter as a condition of the prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.
- 11. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.
- 12. The winner(s) agree to participate in any publicity or other such promotional activities which the Promoter may reasonably require in connection with the prize promotion and the Promoter shall have the right to use each winner’s name, likeness, image, voice and biographical information for advertising and promotional purposes in connection with the prize promotion in all media without further notice and without the need to make any payment to any winner for such use.
- 13. All entries become and remain the property of the Promoter. The information entrants provide will be used for the purpose of conducting this competition, and for any other purpose to which entrants consent to such information being used. The Promoter may disclose entrant’s personal information to its contractors and agents to assist in conducting this competition or communicating with entrants and winners’ names may be published as required under any relevant legislation.
