Alan John McEwan was appealing a conviction in New South Wales for possession of child pornography and using his computer to access child pornography after he was found with pictures modelled in the images of fictional child characters Bart and Lisa Simpson, depicting them having sex.
McEwan was convicted and fined AUS$3,000 and placed on a good behaviour bond.
Judge Justice Michael Adams said: "In my view, the magistrate was correct. The word 'person' included fictional or imaginary characters."
"The mere fact that the figure depicted departed from a realistic representation in some respects of a human being did not mean that such a figure was not a 'person'."
